This is the privacy policy of this website and the legal entity, as listed in the footer of this website, rendering this website and associated products and / or services, herein after referred to as The Company.

Interpretations

"we"; and "us"; and "our" refer to The Company.

The terms “you” “yourself” and “your”, refer to you, being that person who reads and accepts this Privacy Policy.

"Agreements" means our various policies and agreements, including but not limited to, Terms and Conditions, Privacy Policy, Refund and Return Policy and Services Agreement.

"Card Associations" means individually or collectively China UnionPay, MasterCard, VISA and such other card associations, payment card scheme and/or organisation which runs a payment programme.

"Card Association Rules" means the rules, regulations and policies of the Card Associations as they currently apply or as same may be amended, modified or replaced from time to time.

"CVV2" means a number found on the back of a credit card, which means card verification value 2 and may sometime be referred to as CVC2 which stands for card validation code 2 or CID which means card identification number. For American Express, the code is a four-digit number on the front of the card above the account number.

"Financial Information" means financial information relating to your personal finances which may include information concerning credit cards, bank accounts and related information.

"Personal Data" means information relating to the Data Subject which includes personally identifiable information.

"Process/ Processing" means an operation or set of operations performed on personal data or sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

"Profiling" means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to an individual, in particular to analyse or predict aspects concerning that individual’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

"Services Agreement" means the agreement entered into between you and The Company, either written or oral and however so recorded, that confirms the understanding between The Company and you pertaining to the provision of Services including inter alia the general terms of service and the terms of payment for said Services.

INTRODUCTION

The Company takes your right to privacy seriously and wants you to feel comfortable using our Site.

By using our Site, you are agreeing to the terms and conditions of this Privacy Policy.

We, by Processing Personal Data, as part of the Services provided under the Terms and Conditions acts as the Data Processor of Personal Data, under the direction and responsibility of us in our role as Data Controller of Personal Data.

When you contact us either via email, email form or chat (within the Site) or by telephone, we may, as part of the buying and selling process, collect certain personal information such as your name, date of birth, address, and email address. We may also request information concerning your finances (debits and credits), financial service providers, personal budgets, financial plans, retirement, and education goals.

This Privacy Policy does not apply to other entities that are not owned or controlled by our appointed person or entity in the capacity of Site administrator ("Site Administrator"), nor does it apply to persons that are not employees or agents of the Site Administrator, or that are not under the Site Administrator’s control.

Such purposes may include, amongst others (i) completing an application for Services (pre-contractual) (ii) completing the Service Agreement (iii) automated processing including Profiling (iv) completing a transaction (v) verifying your credit card details for payment or arranging for a refund (vi) communications with our call operators and consultants.

Subject to your prior express consent we may also perform voice recordings of conversations between you and our call operators and/ or consultants. Before recoding any voice conversations, we shall first require your prior express and verifiable consent. Such recordings are meant to benefit and substantiate the accurate recoding of your Personal Data and Financial Information to provide the Services.

You may decline us performing any voice recordings.

In assessing your eligibility for the Services, we may perform certain automated processing of your Personal Data which may involve Profiling, e.g. Using credit referencing agencies. In such case we shall notify you of such automation processing and only perform such automated processing with your prior express consent. Profiling may, in certain circumstances, put at risk certain of your rights and freedoms and as such we will inform you of the implications in advance of performing any automated processing, for you to assess, considering the information at hand, if indeed you wish to provide consent.

In all circumstances we will provide you with an opportunity to say no.

WITHDRAWAL OF CONSENT

If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your Personal Data, at any time, by contacting us via email or by following our opt-out instructions or by sending a mail to us.

You may not be able to opt-out of all information sharing, such as information sharing with credit card processors, in connection with payment for Services already provided by The Company or certain information sharing with third parties that we are legally required to provide imposed on us by law. (For more information, see Disclosure below).

PROCESSING OF PERSONAL DATA

Subject to your prior express and verifiable consent, we will process your Personal Data for certain purposes (see CONSENT, above) either, via the Site, email, chat technology, voice over IP (VOIP), telephone or on paper taken by our call operators and/ or consultants.

Such Personal Data will typically include, but not limited to, (i) your valid e-mail address (ii) your username (that has not been chosen already) (iii) your full name, (iv) your street address, city, postal code and (v) your date of birth. (See Terms and Conditions for more information on the provisions that apply to you concerning your registration obligations, user conduct and content submissions in addition to provisions that apply to you within this Privacy Policy).

PROCESSING OF FINANCIAL INFORMATION AND PERSONAL DATA

In addition to Personal Data and again subject to your prior express and verifiable consent, we may, to perform the Services, also request certain Financial Information from you concerning your personal finances. Such Financial Information may include information concerning your financial service providers, your personal budgets, your financial plans, your retirement and education goals and related information.

Such Financial Information may be used in automated processing which may involve Profiling (see CONSENT, above).

Processing of your Financial Information, subject to this Privacy Policy, is to aid the efficient performance of the Services. In certain circumstances our consultants may join you on a call with your bank or credit institution to assist you in obtaining more favourable terms and interest rates. In such instances our consultants may be privy to certain information concerning your accounts which may be of a sensitive nature. In such event we shall disclose to you what information may have been gleaned under such circumstances and will always make available to you access to your records for you to assess what Financial Information or Personal Data we may have on record. Your rights (see OUR OBLIGATIONS AND YOUR RIGHTS, below) will always apply, including inter alia destruction of such information.

Under no circumstances, shall we record your credit card data (credit card number, CVV2 number, valid and expiry dates) unless for payment purposes (see below, PAYMENT) and even in such instance, we shall never maintain a record of your CVV2 number.

USE OF PERSONAL DATA

We only collect Personal Data that is relevant to the purpose and business of our Site. This information allows us to provide you with a customized and efficient experience. We do not process this information in a way that is incompatible with this objective.

The general use of our Site does not require registration and as such, subject to the restrictions and provisions of this Privacy Policy, you can visit our website without providing your Personal Data.

However, in providing certain Services we may require registration which may involve the Processing of Personal Data.

If you choose not to provide consent or withhold certain Personal Data from us, then it may not be possible for you to gain access to certain parts of the Site, nor for us to be able to provide the Services or certain aspects of the Services.

OUR OBLIGATIONS

Notwithstanding the obligations provided for in the Terms and Conditions and this Privacy Policy, we are also obligated by the provisions of the Data Protection Act ensuring that processing of your Personal Data is lawful, fair, transparent, adequate, relevant, accurate, kept for as long as required and proportionate to the purposes for which it is being used.

Subject to a written request by you, we are obligated to provide you with access to your Personal Data and as such provide you with a copy our records pertaining to your Personal Data. If you require such access then please go to Questions and Requests and Contact information, below.

If you cease to be a subscriber or member or customer of The Company then, subject to not contravening the requirements of the law, we will be obliged to destroy your Personal Data.

Might there be a security breach concerning your Personal Data and such breach is likely to result in a high risk to your rights and freedoms, then, in such instance, we will be obliged to inform you as soon as possible without undue delay.

SECURITY

Further to our obligations concerning the processing of your Personal Data under the Data Protection Act (see under OUR OBLIGATIONS and YOUR RIGHTS) we shall ensure that your Personal Data is securely processed.

To protect your Personal Data, we also take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered, or destroyed.

If you provide us with sensitive information, such as login credentials and credit card information, then such information is encrypted using secure socket layer technology (SSL) and stored with AES-256 encryption." Although no method of transmission over the Internet or electronic storage is 100% secure, we use generally commercially acceptable standards to protect your personal information and data.

PAYMENT

If you pay us by credit or debit card, we will use a direct payment gateway to complete your purchase, then we will store your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of the Card Associations.

Subscription Service Bundle

Our Subscription Service Bundle consists out of various Service Components as described on this website, for which The Client, has subscribed during our registration process pursuant to this website. These individual Service Components may be offered to you as part of your Monthly Subscription Fee or Free of Charge as an added value benefit to you.

Service Options, Registration & Subscription Fees

You may choose one of our 3 service options during your online registration process (Bronze, Silver or Gold).

Subject to these Terms & Conditions, The Client’s monthly Subscription Fee will entitle The Client to All the product benefits included under The Client’s selected service option.

All our product service options require you to pay applicable registration fees. These registration fees may be processed via a secure card association (Master/VISA/CUP) process for online transactions, or via recurring card not present protocol.

Should you not make payment of these registration fee, you will still be regarded as an active customer, but will be prohibited from making use of any of our services, until you have paid your registration fees via an approved secure online process.

Your Monthly Subscription Fees will be collected each month from your indicated card account, on, or as close as possible to, the day that you normally receive your income, as indicated by you. We may re-present any failed transactions against your indicated card account on any subsequent day in our sole discretion.

Your applicable monthly subscription fee is payable in advance each month from date of registration, on or close to, your salary day, until cancellation of this service agreement. You hereby irrevocably authorise and instruct us, directly or indirectly, to collect any money due by you and to pay any money due to you, via your nominated debit card or credit card, as may be substituted from time to time.

We may change any of our fees and any other conditions when deemed necessary by us, and we shall inform you in writing about such changes in advance by at least 15 days via any form of electronic communication.

Product Pricing & Benefits

The product pricing and benefits, as set out in our product website, in the Billing Currency will apply, subject to change from time to time, and as published on this product website:

All prices are inclusive of VAT and or other sales taxes.

Payment Currency

The Company may process the payment of any applicable fees in an equivalent amount in another currency, other than the Billing Currency, should we be unable to process payments in the Billing Currency, for whatsoever reason.

We shall endeavour to ensure that the converted amount in the Payment Currency is as close as possible to the Billing Currency amount in value. We reserve the right to calculate the Payment Currency conversion rate at our own discretion, within reason.

General Provisions

All the information you provide us should be true and correct and will be treated as confidential. We may, however, provide such information to any third party to assess your application or render “The Service”, or upon default.

You acknowledge that we may communicate with you from time to time via any electronic communication channel available for any reasonable reason.

Should we provide any third-party insurance products as part of “The Service”, these products will have their own terms and conditions, that would be sent to you via separate communication. No benefits or service requests will be honoured if service fees are in arrears or short paid.

Payments Policy

Processing of all applicable payments are provided by reputable Payment Processors. Card transactions will be acquired for us via approved payment gateways. Our chosen Payment Processors use the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website.

Our payments are fully PCI DSS Compliant. Compliance with PCI DSS means inter alia that our payment provider has its systems secured and customers can trust us with their sensitive payment card information. PCI DSS is an active certification and ongoing oversight by independent auditors who are procured to ensure that we are always compliant.

We may accept VISA®, VISA Electron®, MasterCard®, Maestro®, China UnionPay® Diners or American Express.

We require your card number, the expiry date, the CVV number (that’s usually the last 3 digits on the back of your card) and your name exactly as it appears on the front of the card.

Registration Fees may be deducted upon date of registration or any time thereafter. Monthly Subscription Fees will be deducted as close as possible to your indicated salary payment date. You have also authorised us to re-present payments against your card, should initial presentment fail.

Payment Cards used for the first time on our website together with any large or unusual payment card transactions will need to be validated by the issuing bank or the cardholder before your order can be processed.

Card Holder Jurisdiction

The cardholder is responsible for any / all extra charges applied within their states and / or country. Any and all jurisdictional laws within the cardholder’s state and / or country surrounding these types of transactions are the responsibility of the cardholder.

Consumer Satisfaction

All sales are 100 percent guaranteed for consumer satisfaction.

We do not accept payment by cash or money order. We accept Visa, MasterCard or China UnionPay payments only by using a secure server payment gateway. When charged, The Company reference will appear on your card statement.

Privacy

The Client hereby undertakes to review and familiarise itself with our Privacy Policy, to ensure that The Client understands our practices.

Electronic Communications

When you use any of our services or send emails to us, you are communicating with us electronically. We will communicate with you by e-mail or by posting notices on the website or through other Services of The Company. You may not misuse the service. You may use the service only as permitted by law. The licenses granted by The Company pursuant to this agreement may at any time be terminated by The Company if you in any manner do not comply with these Terms of Service.

Reviews & Contents

Visitors may post reviews, comments and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions or other information, as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any form of "spam". You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. We reserve the right to remove or edit such content. If you believe that any content on or advertised for sale on the service contains a defamatory statement, or that your intellectual property rights are being infringed by an item or information on the service, please notify us by submitting a formal notice to us and we will respond.

If you post content or submit material, and unless we indicate otherwise, you grant: (a) The Company a non-exclusive, royalty-free and fully sub-licensable and transferable rights to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media; and (b) The Company, its sub-licensees and transferees the right to use the name that you submit in connection with such content, if they choose. No moral rights are assigned under this provision.

You agree that the rights you grant above are irrevocable during the entire period of protection of your intellectual property rights associated with such content and material. To the extent permitted by law, you agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content. Liability

We will do our utmost to ensure that availability of the service will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed. Also, your access to the service may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services. We will attempt to limit the frequency and duration of any such suspension or restriction.

The company will not be responsible for losses that were not caused by any breach on our part, or any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure), or any indirect or consequential losses that were not foreseeable to both you and us when you commenced using The Company Services.

The Company will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any because which is beyond our reasonable control. This condition does not affect your legal right to have goods sent or services provided within a reasonable time or to receive a refund if goods or services ordered cannot be supplied within a reasonable time owing to a cause beyond our reasonable control.

The laws of some countries do not allow some or all, of the limitations described above. If these laws apply to you, some or all the above limitations may not apply to you and you might have additional rights.

Nothing in these conditions limits or excludes our responsibility for fraudulent representations made by us or for death or personal injury caused by our negligence or wilful misconduct.

Country of Domicile & Applicable Law

The Company is incorporated in the Republic of South Africa and subject to its laws, regulations and treaties.

The Company chooses the address as stated in the Contact Us page of this website as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

Alterations & Severability

The Company may, in its sole discretion, change this agreement or any part thereof at any time without notice.

We reserve the right to make changes to any of The Company Services, policies, terms of service including these Terms of Service at any time. You will be subject to the Terms of Service and policies in force at the time that you use The Company Services. If any of these Terms of Service is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

Waiver

If you breach these Terms of Service and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms of Service.

Children

We do not sell products for purchase by children. If you are under 18 you may use The Company’s services only with the direct approval and involvement of a parent or guardian.

Our Policy in Respect of Chargebacks

When a transaction is disputed, the bank which issued the related card (Issuer Bank) and the Merchant`s bank which is sponsoring the account of the related Merchant (Sponsor/Acquirer Bank), operate according to clearly defined and well-established procedures to resolve the aforesaid dispute.

These procedures are designed to establish whether the Merchant should receive (or retain) the payment pertaining to the disputed transaction (as processed) or whether the funds should be returned to the Cardholder’s account.

The process of returning the funds to the Cardholder or the Accountholder is known as a Chargeback.

Chargebacks are thus the full reversal of processed transactions by the Issuer Bank.

We only take responsibility for Chargebacks and any fines, fees and assessments arising from the applicable regulatory bodies related to or arising from any such fraudulent transactions.

You fully indemnify and keep indemnified The Company, its directors, employees, group companies, affiliates, Processing Partners, sub-contractors and agents and assignees from and against: All Chargebacks and Refunds related to any transaction processed on behalf of The Company; and any Payment Card Associations’ fines, fees penalties and assessments and acquirers’ administrative charges and any fines, fees and assessments arising from the applicable regulatory bodies related to or arising from any Chargebacks, Refunds or fraudulent Transactions.

Customer details

Customer details will be stored by The Company separately from card details which are entered by the client on the payment service provider’s secure site.

Responsibility

The Company takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

This website and its content may not be reproduced, duplicated, copied, resold, visited or otherwise exploited for any commercial purpose without the express prior written consent of The Company. The license granted hereunder does not allow you to collect product or service listings, descriptions or other information displayed here, and does not allow any derivative use of this website or the content for the benefit of another merchant. Our Refund & Cancellation Policy

We may in our sole discretion cancel and/or suspend any part of your services and/or with immediate effect terminate your service contract, in any of the following events: should we suspect fraudulent activity by you, or any fraudulent activity by any third party in using, or attempting to in any manner use, your card and/or any part of our services provided to you; or, should you terminate your service contract; or, should you breach any of our Terms of Service or should you pass away.

In the event where The Company is no longer able to provide any part of the services, then The Company may terminate your service contract, in respect of such services, subject to The Company providing you with written notification within a period reasonable under the then existing circumstances. In any such event, The Company shall not be obligated to provide substitute services.

You may terminate your Service Contract during the initial 30 days from date of registration, by providing The Company with a written notice of such cancellation and you will be entitled to request a full refund of all subscription fees paid, less the value of any services utilised, or subscription loyalty rewards received.

You may terminate your Service Contract after the initial 30 days from date of registration, by providing The Company with a written notice, after receipt of which, the Terms of Service will stay in full force for three calendar months.

All outstanding monthly fees are due upon cancellation of your subscription.

Nothing in this Policy is intended to limit your statutory rights in any way.
